Vshopper Terms and Conditions

1. General Use

By using the websites (www.vshopper.co.za) and making a purchase, you agree to be bound by these Terms and Conditions. Vshopper (Pty) Ltd reserves the right to update these terms at any time without prior notice. Continued use constitutes acceptance of any changes.

2. Eligibility and Registration

You must be at least 18 years old or have legal guardian consent to use the services. You are responsible for ensuring the confidentiality of your account credentials and for all activity under your account.

3. Products, Pricing, and Availability

  • All products are subject to availability and stock limitations.
  • Prices may change without notice and are inclusive of VAT unless otherwise stated.
  • Promotions and voucher codes may not be combined, are limited in duration, and may apply only to online or selected products.

4. Order and Sale Agreement

  • A sale is concluded only once payment is successfully processed and confirmed.
  • Adding items to the cart does not reserve or confirm availability.
  • Vshopper reserves the right to cancel or refuse any order without explanation.
  • Orders may be limited or refused based on account history, geographic location, or suspected reseller activity.

5. Returns and Refunds

  • Vshopper allows returns within 7 days of receipt if the item is undamaged, in original packaging, and includes all accessories. Refunds may take up to 21 working days.
  • Refunds for card transactions will be made to a verified bank account, not the original card.
  • Reasonable usage charges may apply to returned goods.

6. Delivery and Risk

  • Risk transfers to the customer upon delivery.
  • SIM cards require RICA compliance. Delivery will be refused if a valid ID and proof of address (less than 3 months old) are not presented.

7. Billing and Account Accuracy

  • Customers must provide accurate billing and shipping details and update them as necessary.
  • Vshopper reserves the right to refuse or cancel any order that appears fraudulent or incorrect.

8. TV License Requirement

  • A valid, paid-up TV license and ID are required to purchase a television.
  • The license must match the delivery address and may not be shared.

9. Intellectual Property and Content

  • All content, trademarks, software, and data are the property of Vshopper and protected by intellectual property laws.
  • You may not copy, reproduce, or exploit any part of the services without prior written permission.

10. Third-Party Services and Links

  • Both websites may link to third-party sites. The companies are not responsible for the content or services on those sites.
  • Use of third-party tools or services is at your own risk.

11. Limitation of Liability and Warranties

  • Services and products are provided “as is” and “as available”.
  • No guarantees are made regarding uninterrupted, secure, or error-free service.
  • Liability is limited to the extent permitted by law. Neither company is liable for indirect, incidental, or consequential damages.

12. User Conduct and Prohibited Uses

You may not:

  • Use the services for illegal or harmful purposes.
  • Transmit malicious software.
  • Infringe on intellectual property or personal rights.
  • Misuse promotions or submit false information.

13. Data Protection and Privacy

  • Personal data is handled according to applicable data protection laws (e.g., POPIA, PAIA).
  • Vshopper may collect and use anonymized data for analytics.
  • Customer data will not be shared with third parties for marketing without consent.

14. Dispute Resolution

Disputes not resolved via customer service may be submitted to arbitration in Johannesburg or through the South African legal system, as applicable.

15. Termination

  • You may terminate your use of the services at any time.
  • Either company may suspend or terminate services for breach of terms or misuse.

16. Jurisdiction

These Terms are governed by the laws of South Africa. All legal matters will be handled within South African jurisdiction.
